With the EU AI Act, the use of AI systems now also has a legal guardrail that can also be checked since August 2026. This applies not only to software companies, but to every company where artificial intelligence is in use. From our conversations we know that the following questions, among others, are currently on people\u2019s minds:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Do we need a certificate for AI literacy?<\/li>\n\n\n\n<li>Does the obligation also apply if we only use ChatGPT?<\/li>\n\n\n\n<li>Who in the company is responsible for AI literacy?<\/li>\n\n\n\n<li>In which practical cases does evidence of AI literacy help me?<\/li>\n<\/ul>\n\n\n\n<p>For this, we read the text of the regulation and the European Commission\u2019s answers. It means the \u201cskills, knowledge and understanding\u201d that allow providers, deployers and affected persons \u201cto make an informed deployment of AI systems, as well as to gain awareness about the opportunities and risks of AI and possible harm it can cause\u201d.<\/p>\n\n\n\n<p>How concretely this is meant is shown by the <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/faqs\/ai-literacy-questions-answers\" target=\"_blank\" rel=\"noopener\">European Commission<\/a> with an example. If employees use ChatGPT to write advertising copy or translate texts, the obligation under Article 4 applies to the company. The employees should then know the typical risks, such as hallucinations.<\/p>\n\n\n\n<div style=\"height:60px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Article_4_requires_from_companies\"><\/span>What Article 4 requires from companies<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/DE\/TXT\/HTML\/?uri=OJ:L_202401689\" target=\"_blank\" rel=\"noopener\">L\u2019article 4<\/a> has applied since 2 February 2025 to providers and to deployers of AI systems. A deployer is anyone \u201cusing an AI system under its authority\u201d (Article 3(4)). If your company only buys and uses AI, it is therefore a deployer.<\/p>\n\n\n\n<p>On 27 July 2026, the <a href=\"https:\/\/eur-lex.europa.eu\/eli\/reg\/2026\/1744\/oj\/deu\" target=\"_blank\" rel=\"noopener\">Digital Omnibus Regulation<\/a> entered into force and amended Article 4. Before, companies were to ensure \u201cto their best extent\u201d that their staff have \u201ca sufficient level of AI literacy\u201d. Today, they take measures to support the development of AI literacy among their staff and other persons.<\/p>\n\n\n\n<p>In doing so, they take into account the technical knowledge, experience, education and training of the staff and the context in which the system is used. Also new is the sentence that companies are not obliged to guarantee a specific level of AI literacy for any person. The <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/faqs\/ai-literacy-questions-answers\" target=\"_blank\" rel=\"noopener\">European Commission<\/a> adds that Article 4 remains an obligation, but no longer prescribes a specific or sufficient level.<\/p>\n\n\n\n<p>The obligation extends beyond your own workforce. By \u201cother persons\u201d, the <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/faqs\/ai-literacy-questions-answers\" target=\"_blank\" rel=\"noopener\">European Commission<\/a> means people who work with the system on behalf of the company without being employed there, for example contractors, service providers or clients.<\/p>\n\n\n\n<div style=\"height:60px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Article_4_does_not_require\"><\/span>What Article 4 does not require<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The European Commission updated its <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/faqs\/ai-literacy-questions-answers\" target=\"_blank\" rel=\"noopener\">questions-r\u00e9ponses sur la ma\u00eetrise de l\u2019IA<\/a> on 27 July 2026. For HR, four clarifications in it matter:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>No certificate:<\/strong> Companies can keep an internal record of their training and other measures, a certificate is not needed.<\/li>\n\n\n\n<li><strong>No obligation to measure:<\/strong> Article 4 does not require companies to test their employees\u2019 AI knowledge.<\/li>\n\n\n\n<li><strong>No prescribed training:<\/strong> There is no fixed format. The Commission warns, however, that it is often not enough to simply refer to the system\u2019s instructions for use.<\/li>\n\n\n\n<li><strong>No AI officer:<\/strong> Article 4 does not prescribe a dedicated governance structure.<\/li>\n<\/ul>\n\n\n\n<p>Since August 2026, the national market surveillance authorities supervise Article 4, and they <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/faqs\/ai-literacy-questions-answers\" target=\"_blank\" rel=\"noopener\">can sanction infringements under national law<\/a>. However, the <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/DE\/TXT\/HTML\/?uri=OJ:L_202401689\" target=\"_blank\" rel=\"noopener\">regulation<\/a> does not set a fixed fine range for Article 4 in Article 99, as it does for other articles.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Stricter_rules_for_high-risk_AI_from_December_2027\"><\/span>Stricter rules for high-risk AI from December 2027<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>As listed in <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/DE\/TXT\/HTML\/?uri=OJ:L_202401689\" target=\"_blank\" rel=\"noopener\">Annex III<\/a> , high-risk AI includes AI systems that companies use to recruit or select staff, for example to screen or filter applications. Deployers of such systems must assign human oversight to persons \u201cwho have the necessary competence, training and authority\u201d (Article 26(2)).<\/p>\n\n\n\n<p>According to the amended timeline in the <a href=\"https:\/\/eur-lex.europa.eu\/eli\/reg\/2026\/1744\/oj\/deu\" target=\"_blank\" rel=\"noopener\">Digital Omnibus<\/a> , this obligation applies from 2 December 2027. Before, 2 August 2026 had been planned.<\/p>\n\n\n\n<div style=\"height:60px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_an_overview_per_role_still_helps\"><\/span>Why an overview per role still helps<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As the <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/faqs\/ai-literacy-questions-answers\" target=\"_blank\" rel=\"noopener\">European Commission<\/a> points out, a sanction is more likely if an incident goes back to missing training. By then at the latest, you want to be able to show which role works with which system and what the employees learned for it.<\/p>\n\n\n\n<p>The European Commission collects how companies handle this in a <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/ai-literacy-practices\" target=\"_blank\" rel=\"noopener\">directory of practice examples<\/a>. Two of them follow the logic you know from mandatory training.<\/p>\n\n\n\n<p>At the Norwegian insurer <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/ai-literacy-practices\/gjensidige-forsikring-asa\" target=\"_blank\" rel=\"noopener\">Gjensidige<\/a> , HR is responsible for basic AI training, and the training per role is the responsibility of the respective business unit management. All employees complete a mandatory e-learning, and new employees go through the same programme. Employees in claims handling also receive training on the AI systems used there, including their risks.<\/p>\n\n\n\n<p>Our second example is the <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/ai-literacy-practices\/ingka-group\" target=\"_blank\" rel=\"noopener\">Ingka Group<\/a>, the largest IKEA retailer, which only unlocks advanced generative AI tools once the basic training is complete. Article 4 names as the benchmark the technical knowledge, experience, education and training and the context in which the system is used.<\/li>\n\n\n\n<li><strong>Training:<\/strong> Enter the measure through which the role builds this literacy.
